1878 Feb 8 Milton Co. GA Will BK __, pg. 58,59,60,61 - In the name of God, Amen. I, John NIX of sd. State & County being of advanced age, but of sound & disposing mind & memory, knowing that I must shortly depart this life deem it right & proper both as respects my family & myself that I should make a disposition of the property with which a kind providence has blessed me. I do therefore make this my Last Will & Testament hereby revoking & anullling all others by me heretofore made. 1st: I desire & direct that my body be buried in a decent & christian like manner suitable to my circumstances & condition in life. My soul I trust shall return to rest with God who gave it as I hope for salvation through the merits & atonement of the blessed Lord & Saviour Jesus Christ. 2nd: I desire & direct that all my just debts be paid without delay by my executors hereinafter named & appointed. 3rd: I give bequeath & devise to my beloved wife Francis NIX & my daughter Lucy Ann NIX to have hold & enjoy the same for & during the natural life of my sd. wife Francis NIX jointly provided the sd. Lucy Ann NIX lives with my sd. wife Francis NIX & if not to my sd. wife alone all my tract of land known as the old homestead consisting of lots of land numbers 632, 706, 707, 734, 735, 736, 777, 778 & 10 acres of 779, all lying in the 2nd Dist. & 2nd Sect. of originally Cherokee County & containing each 40 acres + or - and at the death of sd. wife Francis NIX I do desire that sd. land be sold & the proceeds thereof be divided among my heirs hereinafter mentioned. I further give & bequeath to my sd. wife & daughter to have & to hold the same as aforesaid 2 mules, a 2 horse wagon such as she may select & 2 hundred bushels of corn, 25 bushels of wheat, 200 pounds of bacon & farming tools & gears sufficient to make a 2 horse crop. 4th: I will & desire that my grandson Thomas Jefferson COCHRAN provided he remains & lives with my sd. wife Francis NIX until he marries or becomes of age be given a common school education at the expense of my estate & upon his marriage or arrival at the age of majority he be given a horse, bridle & saddle of the value of $100.00. 5th: I will & desire that the residue of my estate both real & personal be sold & equally divided among Susan STEPHENS or the heirs of her body, Polly MADDOX or the heirs of her body, Patsy HOOD or the heirs of her body, Charles NIX or the heirs of his body & Alexander NIX son of Wiley NIX or the heirs of his body & Lucy A. NIX or the heirs of her body it being my desire that each of my children & the sd. Alexander NIX aforesaid shall have an equal portion of my estate & in the event of the death of any one of my children or the sd. Alexander NIX aforesaid then his or her children shall succeed to his or her equal portion of sd. estate. I further will & desire that upon the death of my wife Francis NIX the land mentioned in the 3rd. item of this my Will with all other property which she may have the same being the profits arising from said land or the personal property bequeathed in said item be sold & equally divided among my heirs as aforesaid. It further being my desire to expressly disinherit Sally COCHRAN & her children & Elizabeth Phillips & her children. I hereby constitute & appoint my son Charles NIX & my son-in-law John STEPHENS Executors of this my LW&T. /s/ John NIX.
